Terms of Service

1. Acceptance of Terms

By accessing or using MogGPT ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes.

2. Eligibility

You must be at least 18 years of age to use MogGPT. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account & Authentication

To use MogGPT, you must create an account using a valid email address. Authentication is handled via magic link (passwordless login). You are responsible for maintaining the security of your email account and for all activity that occurs under your MogGPT account. You may not create multiple accounts or share your account with others. You must notify us immediately of any unauthorized use of your account.

4. Service Description

MogGPT is an AI-powered photo generation service. You upload photos of yourself, and our AI generates styled, edited versions of those photos. The Service uses artificial intelligence and machine learning to process your uploaded images and produce new images based on selected styles and prompts. All output images are AI-generated content and may not perfectly represent your actual appearance.

5. Subscription Plans & Payments

MogGPT offers the following subscription plans:

  • Monthly — $40/month
  • Quarterly — $99/quarter
  • Annual — $349/year

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your selected payment method on a recurring basis according to your chosen plan. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time within a billing cycle. We reserve the right to change pricing with reasonable notice. Price changes will apply to the next billing cycle after notice is given.

6. User Content & Upload Rules

When uploading photos to MogGPT, you must follow these rules:

  • Upload only photos of yourself
  • No group photos
  • JPEG or PNG format only
  • Maximum file size of 10MB per photo

By uploading photos, you represent and warrant that you own the rights to those photos and that they depict only you. You grant MogGPT a limited, non-exclusive license to process your uploaded photos solely for the purpose of providing the Service. We do not use your uploaded photos for AI model training or any purpose beyond generating your requested outputs.

We reserve the right to reject or remove uploads that violate these rules, and to cancel associated generations without refund.

7. AI-Generated Content

All images produced by MogGPT are AI-generated content. You acknowledge and agree that:

  • Generated images are artificial and may not accurately represent your real appearance
  • Results vary based on input quality, selected styles, and AI processing
  • MogGPT does not guarantee any specific outcome, quality level, or result
  • MogGPT does not guarantee matches, dates, attractiveness, or any social outcomes from using generated photos
  • You are solely responsible for how you use AI-generated images, including on third-party platforms

8. Intellectual Property

Your uploads: You retain all rights to the photos you upload. MogGPT does not claim ownership of your uploaded content.

Generated outputs: You are granted a non-exclusive, worldwide, royalty-free license to use, download, and share the AI-generated images produced from your uploads for personal, non-commercial use. MogGPT does not claim ownership of generated outputs.

The Service: All other content, trademarks, logos, and intellectual property associated with MogGPT remain the property of MogGPT and its licensors. You may not copy, modify, or distribute any part of the Service without prior written consent.

9. Prohibited Uses

You may not use MogGPT to:

  • Generate images of other people without their consent or impersonate others
  • Create illegal, harmful, harassing, defamatory, or obscene content
  • Deceive or defraud others, including catfishing or identity fraud
  • Circumvent, disable, or interfere with security features of the Service
  • Use automated tools, bots, or scrapers to access the Service
  • Reverse-engineer, decompile, or attempt to extract source code from the Service
  • Resell, redistribute, or commercially exploit generated images without authorization

Violation of these rules may result in immediate account termination without refund.

10. Data Retention

MogGPT retains your data according to the following schedule:

  • Source photos: Automatically deleted 24 hours after upload
  • Generated outputs: Automatically deleted 7 days after generation
  • Account data: Retained until you delete your account

You may manually delete your photos and generated images at any time through your account dashboard. Deleted data is permanently removed from our storage systems.

11. Termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. We will delete your stored data in accordance with our retention schedule. You may also delete your account at any time through your account settings.

12. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOGGPT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO MOGGPT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, by sending you an email notification. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
